WASHINGTON, DC — U.S. Supreme Court Justice Brett Kavanaugh September 8th refused the Missouri Secretary of State’s appeal of a state supreme court ruling. It allows a redistricting ballot measure to go forward and a fairer congressional map used in November. But it may not be over.
At issue is a state ballot measure which would roll back a 2025 redistricting map, gerrymandered at President Donald Trump’s request, to gain an additional GOP congressional seat. The ballot measure would return a Kansas City district to the fairer 2022 map. After stonewalling the measure’s approval for 8 months Missouri Secretary of State Denny Hoskins declared the ballot measure not valid under the state constitution. September 3rd, the Missouri Supreme Court ruled unanimously that the measure WAS constitutional and ordered the 2022 maps to be used in November’s election.
September 8th, in his oversight of the 8th Circuit, U.S. Supreme Court Justice Brett Kavanaugh denied the state’s stay request, allowing the Missouri Supreme Court’s decision to stand.
Shortly after Kavanaugh’s denial, a Missouri federal court issued a restraining order, citing the U.S. Supreme Court’s Purcell Principle, not allowing changes too close to an election. It mandates use of the 2025 map, having been used in the primary, saying use of the 2022 map would harm the public. It’s likely to again be appealed.
