In late June, a federal district court issued a temporary injunction preventing the U.S. Postal Service from implementing President Trump’s plan to have the USPS verify citizenship for mail-in voters. The injunction applied only to the 23 states which challenged Trump’s order, but August 11th, that injunction was expanded nationwide.
June 25th, a federal district judge blocked the U.S. Postal Service from implementing key sections of the order, writing, “The Constitution does not grant the President any specific powers over elections.” The judge enjoined the administration from implementing the order’s Sections 2 and 3. The administration appealed, but a First Circuit panel upheld the district court. The administration then appealed to the U.S. Supreme Court.
August 11th, with no ruling from the high court and the general election looming, Massachusetts District Court Judge Indira Talwani determined the case was “ripe”, and expanded her injunction to all states. Talwani wrote, “With respect to the public interest, Defendants and Intervenor-Defendants have notably declined to argue that enjoining implementation of the EO [Executive Order] will jeopardize the integrity of mail-in voting. The record is devoid of any evidentiary support of illegal or fraudulent absentee voting,” UNQUOTE.
DOJ has asked the high court to act quickly to overturn the injunctions.
