With the SAVE America Act Stalling in Congress, Look for Renewed Efforts to Pass Similar Restrictions in State Legislatures



With the SAVE America Act now stalled in Congress and unlikely to pass, more GOP-dominated state legislatures may take up SAVE Act-like, restrictive proof of citizenship and narrower voter ID options.  Some have already passed similar provisions.

We recently reported that President Donald Trump, in his quest to prevent almost non-existent noncitizen voting, attempted to get the SAVE America Act attached to must-pass bipartisan legislation in the U.S. House and Senate.  That push  has largely failed due to the filibuster, and waning support among moderate Republicans. Now there’s a renewed focus on the states.

Voting Rights Lab reports that 28 bills in 17 states were filed this session attempting to implement documentary proof of citizenship requirements. Most failed, but Florida, Mississippi, Utah and South Dakota passed restrictions, but weaker than the SAVE Act. New Hampshire’s 2024 law, passed with no evidence of widespread noncitizen voting, was struck down May 30th after it disenfranchised over a hundred eligible voters.  Wyoming passed its legislation in 2025.

Eight states passed legislation narrowing voter ID options, including Florida, New Hampshire, Utah, Kentucky, and Alabama. Six other states, Arizona, California, Nevada, North Carolina, Ohio and Oklahoma, have ballot measures this fall to enshrine narrow voter options in their constitution. 

If 2026 is any indication, look for more red states to push SAVE Act provisions prior to the 2028 Presidential election.
