WASHINGTON, DC — The U.S. Supreme Court’s decision August 24th allowing President Donald Trump’s plan for the U.S. Postal Service to verify the citizenship of mail-in voters to proceed may not be the final word. The USPS has now released its rules, and pro-voter groups have already challenged them.
The majority’s stay cited the lack of final rules from USPS and DHS, deciding that the 23 state plaintiffs had not yet been harmed. August 21st, the new USPS rules were finalized.
UCLA Law Professor Rick Hasen writes in Election Law Blog, “The Court makes it clear that its order allowing the USPS and DHS to issue final rules, [now quoting the opinion] “does not mean that any measure taken by the Government to implement the Order will necessarily be lawful. On that score, time will tell.”
The Campaign Legal Center, for several pro-voter groups, filed a challenge to the new USPS rules August 25th. QUOTE:
“Since the advent of modern mail and absentee voting as we know it, States have established the governing rules, and local jurisdictions have implemented them in coordination with state election officials. Absent express congressional authorization, no federal agency—including the Postal Service—has, to Plaintiffs’ knowledge, ever attempted to dictate the mechanics of mail voting.”
