President Donald Trump’s March 25th executive order on elections, attempting to override the U.S. Constitution’s grant of election authority to states and Congress, has so far been blocked by four of five lawsuits filed against it. A ruling in one of those cases on September 17th allows a challenge from 19 states to move forward.
The executive order would withhold federal funding from any state which does not implement the use of the National Voter Registration Form, and mandate proof of citizenship documents, including a birth certificate, naturalization papers, a REAL ID-compliant driver’s license or a U.S. Passport. It would also end mail-in ballot grace periods, restrict ballot deadlines to election day, require states to report illegal voting to DOJ, and withholds federal grants if they don’t.
States challenging the order include California, Arizona, Colorado, Connecticut, Delaware, Nevada, Massachusetts, Hawaii, Illinois, Maine, Maryland, Michigan, Minnesota, New Jersey, New Mexico, New York, Rhode Island, Vermont and Wisconsin.
U.S. District Judge Denise Casper issued a stay on Trump’s order in June, saying the States had demonstrated a substantial risk that citizens would be disenfranchised. Judge Casper’s September 17th ruling confirms that the states have legal standing to contest the president’s order, and that they would be harmed, particularly by the withholding of Help America Vote Act funding.
