What Could Go Wrong with Trump’s Mail-In Voting Executive Order and the USPS Plan to Implement It? Bad Data, for One Thing.



In our last report, we shared the U.S. Postal Service’s plans for implementing President Trump’s executive order for verifying the citizenship of mail-in voters.  The flawed data on which the plan relies may result in election chaos and voters being disenfranchised.  

To start, the executive order has been challenged as unconstitutional under the Elections Clause and likely violates state privacy statutes and the federal Privacy Act of 1974.  If it’s not blocked, the order would employ a State Citizenship List with data from Social Security, immigration records, and importantly, the recently overhauled Systematic Alien Verification for Entitlements, or ‘SAVE’, database.  

The Trump administration had hoped to add state personal and voter information such as driver’s licenses and voting history, but only 15 states have complied, according to the Brennan Center for Justice.  

Election officials using the recently overhauled SAVE database to verify citizenship have encountered outdated information which frequently flags citizens as noncitizens.  A February report by ProPublica and the Texas Tribune found 87 naturalized Texas citizens were flagged as noncitizens by the SAVE system. Other states experienced similar results. 

It’s that flawed data that USPS would use when voters receive or mail a ballot, and we don’t yet know how many citizens could be blocked from voting.
