President Donald Trump’s March 31st executive order obstructing mail-in voting spurred five lawsuits from 23 states, 2 coalitions of pro-democracy groups, 2 coalitions of civil rights groups and the Democratic party. The suits universally argue that the constitution does not grant election administration power to the president.
The executive order mandates the U.S. Postal Service to verify voter citizenship eligibility by checking a “state citizenship list,” with data from Social Security and other federal databases.
Attorneys General from 23 states filed a federal lawsuit, including the swing states of Michigan, Wisconsin, Nevada and Arizona, complaining, QUOTE, “Under our Constitution, the President has no authority to restrict voter eligibility or mail voting to lists of voters pre-authorized by the federal government.” UNQUOTE.
The ACLU, representing pro-democracy groups including the League of Women Voters and Association of Americans Resident Overseas among others, argues USPS has no authority to refuse to carry otherwise lawful election mail based on executive directives purporting to dictate voter eligibility,” UNQUOTE.
Two coalitions of civil rights groups, including the NAACP, the League of United Latin American Citizens, and Lawyers’ Committee for Civil Rights Under Law argue the order sows “chaos and confusion” and severely burdens their members’ right to vote.
