A North Carolina State Primary Race Separated by 23 Votes is Likely to End Up in Court After a Second Recount

A North Carolina state senate primary race separated by only 23 votes and marred by accusations of dirty tricks and dark money, will face a partial second recount. Like last year’s state supreme court race, this one is likely headed to court.

It’s a Republican primary race for the District 26 state senate seat, but it’s no ordinary primary. It pits Senate President Phil Berger, one of the most powerful politicians in North Carolina, against challenger Sheriff Sam Page. WUNC reports that Berger raised 34 times as much money as Page. Page’s support came from four political action committees about which little is known because they didn’t file required disclosures before the March 3rd election.

Page emerged the apparent winner by two votes, which expanded to 23 votes after provisional ballots were counted, a lead which held after two machine recounts and one hand recount. Berger is requesting a second full hand recount, but March 23rd, the state election board will conduct only a 3% sample recount district wide, and a full hand recount in three randomly-chosen precincts, and expand it as necessary. The Carolina Journal reports that Berger is also challenging the eligibility of 13 ballots, and accuses a group supporting Page of sending intimidating text messages.

Both candidates are soliciting legal-fund contributions, and it’s likely the contest will be decided in court.
