Midterm Madness Week:  ICE at Polling Places?  The Administration Sends Mixed Messages; Some States are Advancing Laws to Limit or Prohibit It.



In our Midterm Madness series, we’ve reported on federal rules prohibiting deployment of the U.S. military at the polls.  Former Trump advisor Steve Bannon also suggested ICE agents should be used to prevent widespread noncitizen voting, a debunked conspiracy theory.  What rules apply to ICE at the polls?

While voters want to feel safe, law enforcement has sometimes been wielded as a voter suppression tool.  A 2018 study by the University of Cincinnati found a 32% reduction in African American turnout in Alabama due to law enforcement presence.

March 3rd, DHS Secretary Kristi Noem testified the agency had “no plans” to deploy federal agents, but didn’t rule it out entirely. Such a deployment could suppress both turnout of naturalized American immigrants, and American-born Hispanic, Muslim, and African-American communities.

State legislation and the Voting Rights Act of 1965 prohibit voter intimidation, and many states ban firearms in or near polling places, says the Brennan Center for Justice. States Newsroom reports that new legislation in California, Connecticut, Kansas, New Mexico, Pennsylvania, Rhode Island, Virginia and Washington would prohibit immigration law enforcement personnel at the polls and tighten firearms rules. New Mexico’s would ban all federal agents.  Brennan Center expects any Trump administration intimidation to be swiftly challenged in court.
