We have important state updates on proof of citizenship legislation in New Hampshire and Florida, and a bill in Virginia to keep eligible voters from being disenfranchised during purges of noncitizens from voter rolls.
A federal trial began February 9th challenging a strict New Hampshire proof of citizenship law passed in 2024 which resulted in eligible voters being disenfranchised. New Hampshire Public Radio reports that voters and pro-voter groups argued the law creates “significant and unnecessary burdens,” particularly for women whose birth certificates may not match their married name. According to testimony, there have been only 8 cases of noncitizen voting in the last 26 years, most due to misunderstandings.
A Florida proof of citizenship bill advanced out of its first committee in the state senate February 5th. The Florida Phoenix reports that as many as eight million Floridians may not have ready access to the bill’s acceptable proof of citizenship documents.
Virginia lawmakers advanced Senate Bill 52, requiring inspections of voter rolls to identify registered noncitizens to be completed 90 days in advance of the election. Just days before the 2024 election, the U.S. Supreme Court allowed then-Governor Glenn Youngkin to purge 1,600 suspected noncitizens – disenfranchising some later identified as U.S. citizens.
