The “Independent State Legislature Theory” met a skeptical U.S. Supreme Court in 2023 in Moore v. Harper, a North Carolina gerrymandering case. The Michigan GOP tried to employ the fringe theory to undo Michigan’s Question 2 citizen initiative, but the U.S. Supreme Court refused the case May 19th.

Proponents argue the Independent State Legislature Theory gives legislatures ultimate power over federal election rules, based on a widely dismissed interpretation of the elections clause of the U.S. Constitution.  In North Carolina’s case, the legislature admitted it gerrymandered, but said it had the final say, and the courts and governor had no jurisdiction.

In 2022, Michigan’s “Promote the Vote” Question 2 ballot initiative passed 60% to 40%.  It enshrined multiple voting rights in the state constitution, including 9 days of early voting, guaranteeing the right to vote without harassment, offering a permanent vote by mail list, and mandating drop boxes and several other important voting reforms.

Eleven GOP legislators tried to invalidate the ballot question, using the ISL theory. They argued only the state legislature could make election law  – not those pesky constituents.  The Michigan Supreme Court dismissed the case in April 2024, and on May 19th, the U.S. Supreme Court refused to hear the case.

With a vote on the SAVE Act imminent in the U.S. House, Secretaries of State, pro-voter groups and elections officials are voicing alarm at likely widespread disenfranchisement of eligible voters and an unfunded mandate by Congress.

The Safeguard American Voter Eligibility Act’s sponsor seeks to keep “foreign nationals” from voting in federal elections – already illegal –  without any evidence of widespread noncitizen voting in any state.

It will, however, keep eligible Americans from voting.  It mandates proof of citizenship to register or when updating records, but limits that proof to a birth certificate, U.S. Passport, or naturalization papers. Nine percent of Americans don’t have those documents readily available, and because they have to be presented in person, working Americans, seniors and the disabled will all be impacted.  Driver’s licenses, even REAL ID-compliant ones, can’t be used. Even with a birth certificate, 69 million married women changed their name upon marriage, and 146 million Americans don’t own a valid passport, according to the Center for American Progress.

The group Declaration for American Democracy just submitted a letter from over 100 member organizations, citing its impact on rural voters, voters of color, women and victims of natural disasters.  Election officials convened by Issue One cited criminal penalties for errors and the unfunded costs to implement it.   Fourteen secretaries of state and counting now oppose the bill.

Prior to the  2024 election, President Donald Trump made baseless allegations of widespread noncitizen voting, spurring election officials in Iowa and other states to identify suspected noncitizens on their voter rolls.  It also generated restrictive proof of citizenship legislation in Iowa and 18 other states.

Two weeks before the election, the Iowa Secretary of State directed county election officials to challenge 2,176 registered voters it suspected were noncitizens, and therefore not eligible to vote by state or federal law. Iowa, like Virginia and Alabama, found most of its alleged illegal voters were actually naturalized citizens.  It’s unclear how many were disenfranchised.

Of the 277 Iowa noncitizens found to be illegally registered, only 35 voted. Illegal to be sure, but only 0.00209% of the over 1.67 million ballots cast.  Eighteen voted in person, 15 by mail, and 2 cast provisional ballots.  Five others had their ballots rejected, and 22 did not vote.  The 277 have been referred to law enforcement, while Senate Bill 550, requiring citizenship documents at registration, advances in the      legislature.

New Hampshire’s new proof of citizenship law is already in effect.  More on how it negatively impacted eligible Granite State voters in a future report.

Utah adopted universal mail-in voting in 2013, with no widespread misuse in its 12 years.  March 6th, the GOP-dominated Utah legislature approved an amended bill to end it in 2029, despite 76% of state voters supporting it.

HB 300 was even more draconian just weeks ago, requiring voters to return  their ballot in person so ID could be shown.  Such a move would have ended the convenience voters like about mail-in voting, and created a burden for rural and Native American voters, who might live hours from a polling place.

The Utah News Dispatch reports the amended bill phases out universal mail-in voting in 2029, rather than immediately.  But in the interim, voters must obtain state-issued voting ID by 2026, and provide four digits from that ID, with signature matching as a backup.  The voting ID would be free only to those proving they can’t afford it.

In 2029, voters can opt-in to a semi-permanent 8-year vote-by-mail list, and election officials would rely only on the voting ID number for identification.   Voters could opt in at the DMV, polling places, or the state’s voter portal.  The bill also extends the ballot return deadline to 8 pm on election day.

Replacing universal mail-in voting is expected to cost taxpayers $6 million dollars annually.  Gov. Spencer Cox is likely to sign it.

Today’s Script

(Variations occur with audio due to editing for time. Today’s Links below the script)

In September 2024, Arizona Secretary of State Adrian Fontes announced an error in state voter rolls involving 97,000 voters, revolving around a state DMV data error.  That number has risen to nearly 200,000, and an easy fix still hasn’t been found.

In 1996, Arizona began requiring proof of citizenship when obtaining a driver’s license.  Since 2005, election officials have asked registered voters with licenses issued before 1996 for proof of citizenship.  But if a driver’s license issued before 1996 needed to be replaced, it was accidentally given a new date of issue, and election officials never knew to ask for citizenship documents.

Votebeat Arizona and the Arizona Mirror report that the investigation is ongoing, but the number affected has now ballooned to 200,000 voters registered, but without proof of citizenship on file.

The Arizona Supreme Court allowed affected voters to vote in November’s election, but now the legislature is considering an emergency measure, House Bill 2038, directing election officials to contact the voters and request citizenship documents.  If not supplied within 35 days, the voter’s status would change to “not registered”, though voters could reactivate their registration by providing documentation right up to election day.  After the 2026 general election, those voters would be dropped.

The Secretary of State’s office is reviewing the proposed legislation.

We have the text of the bill and Votebeat’s reporting linked at AmericanDemocracyMinute.org.  I’m Brian Beihl.
